Court can order military to arrest Nawaz and his family, warns Khursheed Shah-senior lawyers

Opposition Leader in the National Assembly Khursheed Shah has said that court has the right to exercise Article 190 over non-compliance, asking the military to arrest former prime minister Nawaz Sharif and his family members.
“Nawaz Sharif is playing a very dangerous game as him and his family members are not appearing before the National Accountability Bureau (NAB) despite being summoned,” Shah told reporters in Islamabad on Monday, Express News reported.
If this continues to happen, the National Accountability Bureau can issue warrants to arrest the Sharif family, Shah said, adding that court exercising Article 190 can have dangerous consequences.
“Pakistan’s Constitution and law applies equally on every citizen,” the Opposition Leader said. “It is beyond one’s comprehension as to why the government wants confrontation with state institutions.
References against Sharifs: NAB wants to quiz JIT
Regarding the former interior minister Chaudhry Nisar’s Sunday presser in Islamabad, Shah said it would have had worth if addressed outside the Punjab House.
On Saturday, NAB requested the Supreme Court to allow members of the Panama Papers Joint Investigation Team (JIT) to record their statements before the anti-graft watchdog as part of its investigations against the Sharif family and others.
The request came a day after the ousted prime minister and his sons Hassan Nawaz and Hussain Nawaz refused to appear before NAB, which has been ordered by the top court to file references against them.
In its July 28 judgement, a five-member bench of the apex court unanimously declared that Sharif was not sadiq (truthful) and ameen (trustworthy) and hence not qualified to hold a public office. Senior Lawyer and Ex-vice chairman of Pakistan Bar Council (PBC) Mian Abbas Ahmed said that  

Army bound to help SC if it invokes Article 190

As the government remains defiant in the face of Supreme Court orders in a number of cases such as the NAB cases, corruption, the invocation of Article 190 of the constitution by the apex court for the implementation of its orders appears to have become imminent, with constitutional experts saying that in case the court orders the army to get its orders implemented, the army is bound to act in aid of the judiciary.
While the Supreme Court has yet not invoked Article 190, experts say if such a situation arises, the apex court will pass a formal order. Article 190 states: “All executive and judicial authorities throughout Pakistan shall act in aid of the Supreme Court.” under Article 190 of the constitution, the Supreme Court may direct the armed forces to get its verdicts implemented in letter and spirit.
“Under the constitution, the court orders are binding for the government and it has to implement them. However, if someone feels that the court orders are incorrect, they would have to go into a review against the order. But if one does not go for a review, it means that the orders need to be implemented,” he said.
